Britney Spears and Kevin Federline have reportedly reached a settlement regarding custody of their children, with Spears agreeing to Federline's retainment of sole custody for the time being.

Sean Preston, 2, and Jayden James, 1, will be residing with their father. Spears will keep her visitation rights, which allow her two visits and one overnight with her sons each week.

"The case has been settled," Federline's attorney, Mark Vincent Kaplan, told E! Online, adding, "The court still has to approve it."

Both Spears and Federline are due in court on Friday.

According to Kaplan, Federline has said that he needs to "have Britney to be involved in the co-parenting of the kids," but that he needs to be present to be a "structure."

The settlement between both parties comes after a legal battle that began with 50-50 shared custody in July 2007. Spears was then hospitalized on two occasions for mental health problems following a series of public meltdowns, thus losing custody and visitation rights. Eventually, her visitation rights were gradually reinstated.

For now, "Kevin is absolutely delighted," said Kaplan. Still, custody settlements can always be modified, and a source close to Spears has told PEOPLE that the singer will likely be allowed increased visitation rights as time goes on.
