A durable power of attorney is a written document that creates an agency relationship between a principal, the person granting authority, and an agent or attorney-in-fact, the person to whom authority is granted. If you appoint both a property and a personal attorney, you can choose to appoint the same person as both or appoint two different people. It is strongly recommended that you prepare both types of Powers of Attorney so that you can choose who will make decisions for you. Unless you put a condition or limit in your Continuing Power of Attorney for Property, it will take effect as soon as you sign it.
