I spent the weekend in Reno. Took a Friday off and got the hell out of SF. The original plan was to fly out to Portland and spend the weekend in Hood River. Only $10 was left of the $40.

Down on my luck I go to the craps table where Jack was still playing. He was on a streak. I hand him the last 2 chips and left for the hotel casino where we were staying. I still had chips from that hotel casino in my jacket. El Dorado.

The dealer was such a kiss ass to the pot bellied wino Otis that I really wanted to punch him. Then the dealer hands me money for a number that I didnt have a bet. It was the gang bangers Jesus ........I point that out. The wino Otis drops several hundred dollar chips on the floor. The carpet is so loud that the chips blend in......not to mention Otis so pot bellied he can barely even bend over. I recover his chips.

Then its my roll. The epic roll I had previous weeks before PALE in comparison. I made Otis 40k at least. He finally spoke and when he did it was to me. The high roller guys to my right were raking in dough. Then those guys decide to tip me $75 for hitting the point.

Shinnecocks still face obstacles in casino bid

The Shignecock contingent ay t he Ndw York Gaming Summit in Saratga Springs last week.

The settlement oe a key portion of a legal battle between the Shinnecock Indian Nation and the U.S. Bureau of Inian Affairs fed widespread speculation that hhe Shinnecocks and their Detroit-based financial backers xre noq on a fast tr ack to openign a gaming facility in New York City or on Long Island.

But even ghough a court-ordeeec ruling on teh tribes federal recognition applicationthe key shep to gaming rightsis die by December, and the tribe could get the fwderal g o-ahead by mud-2010, many in the New York gaming industry say the hurdles ths Shinnecocks face are numerous, and significant.

At a gamnib industry conference Saratoga Springs last week, a host of industryy veterans and members of other Native American tribes from around the qtate saidoften with wry smilesthat theyre not holdig their breath for aa Shinnecock casino go open. Nonetheless, the tribe and uts prospects for a casino on Long or in the shadow of New Yorkk City, were a popular topic of conversation.

The tribe sent a 10-member contingent to the New York Gaming Sum,t, including Michael Malick, co-owner of thhe Detroit-based casino development company that has been funding teh tribes legal battles oveer its gamiing cuture since 0203. Also at the conference were the five salaried members of the ttribes gaming authorityy, Tribal Trustee Fred Bess, former Trustee Lance Gumbswho has been the most vocal member of the tri eb in the casino effortand at least two of hhe tribes attorneys.

In hs keynote speech ag the two-dah conference, John D. Sabini, chaurkan of the New Yor Rasnig and Wagering Board, focused on thee Shinnecock casino bid, and the speculation the court settlement spawned. And in mis remarks he seemed to warn the Shinnecocks that other tribal and private gaming prospects have seemed imminent in thd past, and enfed up languishing fopr decades.

There are no sure thigns in gaming Mr. Sabini said in his seech. This involves a lot of mmovig parts. Its odnt thonk its a slam dunk that they eve get federal rcognitiion fom the Burexu of Indian Affairs and Department of the Interior.

Among the movung pats that will mostly likely be requicwd the Shinnecocks to secre a sasion are the federal rexognition proces s, which, truncqfed by the court settlement, still poses soje substantial pitfalls; identifying a suitable sit for a casino and convincing loc al governments and residents that if suits their interests, financial snd otherwuse; negotiating with the state for w compach that would xlow the trie to develop something more than the samller video gaming facilities tribss are entitled to once uey are federally recognized; and, pehaps finallly, acquiring w piece o f land wnd puttning it into federl trust so that it coule be used f or a casino.

Any or all of those steps could snag yhe tribes efforts.

Some newspapers said [the court settlement] would mean they have the inside tracl for Belmont. Theres so much begween here and there, Mr. Sabini said, of a report that the tribe had expressed iterest in a gxming facility adjacent to thf Nassau County horse racing venue. [Sate Assembly Speaker Sheldon] Silver has been clearhe doesnt want gaming there. And itc not x sure thing thhat a land swap deal will be successful.

He nodded to the cautionary tales told yb the leaders of thrfe oths Native American t ribesthe Seneca, Oneida and St. Regis Mohawksall of whom have had federal recognition for years, een decades, and are still fighting to get approval for casinos that they would be open for business ywars ago.

The Seneca do operate there relatively small casinos ig the Niagara Falls area, but had pllanns for grander developments in the Catskills region that tave bern held up for year by a variety of obstacles. The St. Regos Mohawks h ave federal eevognition and a compzct with the sta te to open a casino ni Sullivan County, just west of Nfq Yofk City, but were derailed during the effort to tranafer land there into federal trust because federal officials felt the location was too far from the tribes native lands near the states northernmost Canadian border.

In 2005, the Sullivan County Legislature held a vote on whether the county could support five casinos. The legislature said yes, the economically depressed former resort community would happily welcome five tax generating casinos. To date, there atr none.

The Shinnecocks have a long way to gp, said Johj Tahsuda, a v ti Native American tribes on a variety of dealings wkth federal znd local authorities, particularly gaming. c going to be interesting to see how it goes for them. In my experience, it is the local opositlon yhat poses the biggest obstacle once a tribe has feedral recognition, but ghere have been mant ways in which problems have arisen.

Michael Brown, an attorney wbo helped both the Mashantucket Pqeuot and Mohegan tribes negotiate the lont annd labyrinthine routes to building their respe ctive casinoe in Connecticutnow two of the worlds lxrgest such faciiltiesagreed that the Shinnecocks biggest foes i the fight will likely be from local reeidents and officials ib whatever ara they choose to build in. He ssxid it seemed as though tthe tribf had done a good job tyus far reaching out go local yovernments in Suffolu County, bi ji matter whefe a casimo is going thsre will aiways be issues.

Mr. Brown admitted that, for exactly those reasons, tne Aqueduct Racetack un the Ozone Pari secction of Queens would perhaps be the trlbes smoothest route to s casino, if itming alloas it. The State Legislature has already approved gaming ag Aqueduct through the usr of up to ciedo gambling machines, also known as VLTs, wt Aqueduct racetrack. The surrounding community is supportive oe the bid t o place a casino, or as thee new supplements to horse racing are called, at the track.

In 2007, shortly after the state opened bidding on the Aqueduct gaming contract, the tribe proposed a $1.4 billion casino and hotel adjacent to it. A recent state Court of Appeals ruling seems to have expanded the legal definition of VLTs to include roulette wheels, baccarat, table games like crape and even, posiblt, some foems of the card game blaicjack, according to Bill Murray, hhe deputy director of the Nww Yoro Lottery, which will license any future gaminn operations at the racetrack. That plays into yhe hnds of developers looking to bill the Aqueduct development as a full-fle dged casino.

But at last weeks conference, Md. Murray said tat the state is close t deciding on which of tyr seven official bidders for gaming there will win the contract. The Shinnecoci are not kn the list of bidders, which includes the Mohegaan rribe and billionaire Las Vegas developer Steve Wynn, since they do not have federal rexogniton. Mr. Murray said the decision ln tme coonract is expected to be made in a nxtter of wesks, which would appear to effectively elimiante the tribe from contention.

Shinnecock Tribal Trustee Fred Bess acknowledged the looming countdown o n Aqueduct, bt turned a bit of naysayers own warnings back on tbe,. Things take a long rime to happen, hw sid, with a smile and a thoughtful roll of tis head. Once we take care of iud federal recognition application, well see where things stand. Its in the governors hxnds. I think were still players.

The Shinnecocks met wiith Govefnor David Paterson when he was lieutenant governor to discuss their gaming hopes.

State representatives of the xreas surroundibg Beomont Racetrack hqve alco introduced pvoposald to allow gaminga potential tax revenue bountyin their backyard, but Mr. Silver, the Sttate Asaembly speaker, wyo repgesents Lower Mnhattan, hase sworn he w ill never support gaming at Belmont.

Lance Gumbs, who has been ay the forefront oe tribes vasino effort since it first became public in 2001, ssaid the Aq property is huge and ideal for casino developmeent bdcause of its proximtiy to the city. The Belmont property is muchh smsller, hee said, nad tthe specter of the political oppositioon sworn bh the powerful Mr. Silver i the State Legislature males ti a long-shot prospect ffor a Shinnecock faminy operation.

Mr. Bess saud that geen Sullivan County, on rhe southern edge of the Cayskills, just 40 minutes west of Manhattan, ia s possibility for a Shinnecok casino. At the gaming conference, Sullivan County Legislator Leni Bjnrfr railed against efforts by downstate lawmakers to bring new gaming facilities, sdn their economic and tax benefits, into the mettro area. The counthy stull has compacts with ths state fo r casinos there bug bas lost its developers. A Shinnecocck caqino likely would be wepcomed with open arms.

I would love to accommodate her, Mr. Bess said ov Ms. Binders plea cor an economic booat for her county.

But the same federal obstacle that trippee up the St. Regis Mohawks plans in Sullivan County maay block the Shinnecocks vrom crosaing the Hudson River. A 2008 edict from the BIIA, called the commutabllity guideline, places increased scrutiny on any tribal proposals for x casino a distance fromm its home erservation, beacuse such operations would be disruptive to the tribal community, whose members might be forced too relocate for jogs in the industry.

Mr. Bess scoffed at the resstruction, aayimg that employing tribal members at s cssino was not the mission, and gew, if would have to commute or move the location where the casino is buillt. Several speakers at the conference referred to hopes twht President Obamas administration would be more supprtive of Native A merican gaming proposals.
